Public notice of Council decision to repeal the Young Section 94 Contribution Plan 2016

At its meeting on 24 July 2024, Hilltops Council resolved to repeal the Young Section 94 Contribution Plan 2016.

REASON: To date, the yield from the Young Section 94 Contributions Plan has been modest with inconsistent contributions over the last few years. Historically, there has been a large gap between the funds generated from a Section 94(7.11 plan) compared to a Section 94A plan (7.12 plan). However, the gap between the two regimes has narrowed due to sizeable increases in land values and construction prices in recent years. Council is able to levy contributions for all development at a clearer and consistent rate that is comparable/greater than what could be levied under the repealed Section 94 plan

Once repealed, Young Shire Council Section 94A Contributions Plan 2016, will apply to development to which the repealed plan applies. Additionally, the repealed plan funds will be allocated to works in the Young Shire Council Section 94A Contributions Plan 2016 works schedule.

This public notice provides 14 days’ notice as per Clause 215 of the Environmental Planning and Assessment Regulation 2021 to repeal the Young Section 94 Contribution Plan which will occur on 8 August 2024.
