ON PUBLIC EXHIBITION

PUBLIC EXHIBITION OF RECLASSIFICATION OF LAND PLANNING PROPOSAL

Hilltops Council is placing the Reclassification of Land Planning Proposal on public exhibition for comment from Wednesday 12 August to Wednesday 9 September 2026.

The Planning Proposal seeks to reclassify land owned by Hilltops Council from community to operational land by amending Schedule 4 – Classification and reclassification of public land of the Hilltops Local Environmental Plan 2022 (Hilltops LEP).

The Planning Proposal covers 33 lots across 20 properties that are proposed to be reclassified from Community to Operational. This is to ensure that Council is able to effectively manage these lands.

Many of the parcels proposed to be reclassified were reverted to Community land as Council did not resolve to classify them within 3 months of their acquisition or as operational on 28 June 1994. These parcels’ function and purpose align more with Operational Land.

The basis of the Planning Proposal primarily seeks to rectify administrative errors by the default classifying of various Council operational assets correctly. All of the properties proposed to be reclassified do not meet the LG Act criteria for community land. It is highlighted that the Planning Proposal does not intend to change the land zoning, minimum lot size or other provisions under the Hilltops LEP.

At the 24 June 2026 Ordinary Council meeting, Hilltops Council resolved to request a Gateway Determination from the NSW Department of Planning, Housing and Infrastructure for the Planning Proposal.

Council received Gateway Determination from the Department of Planning, Housing and Infrastructure on 7 August 2026 and is now placing the Planning Proposal on public exhibition for community consultation for a minimum of 20 working days from Wednesday 12 August to Wednesday 9 September 2026 in line with the Gateway Determination conditions. Additionally, under the Gateway Determination, as the planning proposal represents an administrate change to land classifications only with no interests are changing, Hilltops Council has been delegated as the Local Plan Making Authority from the Minister for Planning.

Hilltops Council seeks community input and feedback on a range of issues. Stakeholder engagement is an important element of the Council decision-making process.

Comments and submissions must be made in writing so they can be considered by Council. Comments can only be considered as formal submissions if the author’s details are included.

Please note that written submissions may be made public as part of a report to a Council meeting.

Several items can be open for public comment at the same time, submissions must clearly specify which topic is being addressed.
